2. The Vehicle

3. Purchase Price & Payment

  1. The Buyer agrees to purchase, and the Seller agrees to sell, the vehicle described above for the agreed price.
  2. The agreed price is the total amount payable. Collection and towing are provided free of charge and are not deducted from the price.
  3. Payment is made to the Seller at the time the vehicle is collected, by the method selected above.

4. Ownership, Warranties & the Seller's Promises

The Seller confirms and warrants that:

  1. They are the legal owner of the vehicle (or are fully authorised to sell it) and have the right to sell it;
  2. The vehicle is sold free of any money owing, loan, lease or security interest (including any interest registered on the Personal Property Securities Register), or any such interest will be discharged from the sale proceeds;
  3. The vehicle is not subject to any court order, and is not reported stolen;
  4. The information the Seller has given about the vehicle is true and correct to the best of their knowledge;
  5. Any personal belongings have been removed from the vehicle before collection.

5. Sold "As Is, Where Is"

  1. The vehicle is sold on an "as is, where is" basis. The Buyer buys the vehicle in its current condition, including for the purposes of dismantling, recycling or resale.
  2. As this is a private sale of a used vehicle to a vehicle dealer/dismantler, the Consumer Guarantees Act protections that apply to a supplier selling to a consumer do not apply to the Seller in this transaction.

6. Transfer of Ownership & Risk

  1. Ownership and all risk in the vehicle transfer to the Buyer once payment is made and the vehicle is collected.
  2. The Seller authorises the Buyer to notify NZTA Waka Kotahi that the vehicle has been sold and, where applicable, dismantled. The Seller agrees to complete any notice of disposal or sale required to record the change of ownership.
  3. From the time of collection, the Buyer is responsible for the vehicle and the Seller is released from any further liability, licensing, fines or costs relating to it.

7. Collection

  1. The Buyer will arrange collection of the vehicle from the agreed location at a mutually convenient time.
  2. The Seller confirms the vehicle is accessible for collection and that the Buyer has permission to enter the collection site to remove it.

8. General

  1. This Agreement is the entire agreement between the parties about the sale of the vehicle and replaces any earlier discussions.
  2. This Agreement is governed by the laws of New Zealand.
  3. If any part of this Agreement is found to be unenforceable, the rest continues to apply.
  4. Personal information collected is handled in accordance with our Privacy Policy.
